Terms of Service

• "Account" means your registered user account for the Service.
• "Content" means any text, images, messages, usernames, profile images, posts, chat messages, links, or other content submitted, uploaded, transmitted, or displayed through the Service.
• "Digital Assets" means cryptographic tokens or digital currencies supported by the Service.
• "Internal Balance" means the ledger-tracked balance shown in the Service.
• "Match" means a skill-based game session (e.g., trivia).
• "Verification" means identity verification, age checks, sanctions screening, geo checks, fraud/risk checks, and other compliance controls.
• "You" means the user of the Service.

2.1 Acceptance. By using the Service, you agree to be bound by these Terms.

2.2 Updates. We may modify these Terms at any time. We will update the "Last Updated" date and may provide notice via the Service or email. Continued use after changes become effective constitutes acceptance.

2.3 Supplemental Terms. Certain features may have additional terms presented in the Service. Those terms are incorporated by reference.

2.4 English Controls. If translated versions exist, the English version controls to the extent permitted by law.

3.1 Age. You must be at least 18 years old (or the age of majority where you reside, if higher).

3.2 Legal Use. You may not use the Service where prohibited. You are solely responsible for determining whether your use is lawful in your location.

3.3 Restricted Persons. You may not use the Service if you are:

• subject to sanctions or located in a sanctioned/restricted region,
• using the Service on behalf of a sanctioned party, or
• otherwise prohibited by law.

3.4 No Representation of Legality Everywhere. We do not represent that the Service is available or legal in all jurisdictions.

4.1 Skill-Based. The Service offers skill-based gameplay experiences where outcomes are intended to be determined by player performance.

4.2 No Advice. Nothing on the Service is legal, tax, financial, or investment advice.

4.3 No Guarantees. We do not guarantee availability, uninterrupted operation, match outcomes, winnings, or error-free results. Network conditions, outages, and maintenance may impact play and transactions.

5.1 Location Restrictions. The Service is not available everywhere. We may restrict or prohibit access (including registration, gameplay, deposits, withdrawals, or chat) based on location, compliance, risk, or operational reasons.

5.2 Prohibited Jurisdictions (Hard Block). The Service is strictly prohibited in the following jurisdictions. You represent and warrant that you are not located in, organized under the laws of, or a resident of:

• Cuba
• Iran
• North Korea (DPRK)
• Covered regions of Ukraine: Crimea, Donetsk, and Luhansk regions

5.3 High-Risk Jurisdictions. The following jurisdictions are subject to enhanced due diligence or blocking based on FATF guidance and may be restricted at our discretion:

• Iran
• North Korea
• Myanmar

5.4 U.S. State Restrictions. The Service is not available to residents of the following U.S. states due to regulatory requirements:

• New York

Additional states may be added based on regulatory developments.

5.5 Your Representations. By using the Service, you represent and warrant that:

• You are not located in any Prohibited Jurisdiction listed above;
• You are not a resident of any restricted U.S. state listed above;
• You are not subject to sanctions administered by OFAC, the UN, or other applicable sanctions authorities;
• You are not acting on behalf of any person or entity in a Prohibited Jurisdiction;
• You accept sole legal responsibility for determining whether your use of the Service is lawful in your jurisdiction.

5.6 Location Determination. We may infer your location using IP address, device signals, account information, and other methods. These methods may be imperfect. You agree to provide accurate location information when requested.

5.7 No Evasion. You agree not to bypass geographic restrictions via VPNs, proxies, location spoofing, false information, or any other means. Suspected evasion may result in immediate account suspension, denial of withdrawals, forfeiture of balances (to the extent permitted by law), and permanent termination.

5.8 Changes to Restricted Jurisdictions. We may update the list of Prohibited Jurisdictions and restricted states at any time based on legal, regulatory, or operational requirements. It is your responsibility to monitor these Terms for changes.

6.1 Accurate Information. You must provide accurate and current information and keep it updated.

6.2 Account Security. You are responsible for maintaining confidentiality of your credentials and for all activity under your Account.

6.3 One Account. Unless we approve otherwise in writing, you may maintain only one Account. Multi-accounting, account sharing, and selling/transferring Accounts are prohibited.

6.4 Unauthorized Use. Notify us immediately if you suspect unauthorized access. We may require Verification before restoring access or permitting withdrawals.

7.1 Verification Anytime. We may require Verification at any time, including before withdrawals or continued access.

7.2 Providers. You authorize us and our providers to collect, process, and verify your information for Verification, including screening and risk checks.

7.3 Holds and Reviews. We may delay, deny, suspend, or place holds on transactions, gameplay, or withdrawals if we reasonably believe there is compliance risk, fraud risk, error, prohibited conduct, or security risk.

7.4 Failure to Cooperate. If you fail to provide requested information, we may restrict or terminate your Account.

8.1 Supported Assets Only. You must send only supported Digital Assets on supported networks to addresses we provide. Wrong asset/wrong network transfers may be unrecoverable.

8.2 Confirmations; Credit Timing. Deposits are credited to your Internal Balance only after we detect and confirm the transaction under our policies. Timing may vary.

8.3 Internal Ledger. Balances in the Service reflect internal ledger entries and may not correspond to on-chain balances at any moment.

8.4 Corrections. If we discover errors (including crediting/settlement bugs), you agree we may correct them, including reversing or adjusting Internal Balances and match results, to the extent permitted by law.

8.5 No Insurance. Digital Assets and Internal Balances are not insured by any government program.

9.1 Eligibility. Withdrawals are subject to Verification, geo restrictions, sanctions screening, fraud checks, velocity limits, cooldowns, and operational constraints.

9.2 Requests. A withdrawal request may be pending and is not final until processed and, where applicable, transmitted on-chain.

9.3 Finality. Digital Asset transactions are generally irreversible. Once broadcast/confirmed, they may not be reversible.

9.4 Fees/Network Conditions. Network fees, congestion, forks, and outages may affect timing and amounts received. We are not responsible for delays due to network conditions.

9.5 Address Responsibility. You are responsible for providing correct withdrawal addresses. We are not liable for user errors in addresses.

9.6 Denials. We may deny or reverse withdrawal requests pre-broadcast if we reasonably believe they are linked to prohibited conduct, error, or risk.

10.1 Fees. We may charge fees related to gameplay, withdrawals, or features. Fees are disclosed in the Service and may change.

10.2 Taxes. You are solely responsible for taxes related to your use, including winnings and Digital Asset transactions.

11.1 Rules in Service. Match rules (format, scoring, timing, prize distribution) are defined in the Service and may change.

11.2 Integrity Controls. We may use automated/manual methods to detect cheating, collusion, botting, exploitation, and abuse.

11.3 Adjustments. If we reasonably determine integrity was compromised (or due to outages/errors), we may void matches, adjust results, reverse credits, deny payouts, and restrict accounts, to the extent permitted by law.

11.4 Logs Control. Our recorded results and logs control absent manifest error.

12.1 Discretionary. Promotions may be offered or removed at our discretion.

12.2 Conditions. Promotional credits may be non-withdrawable and subject to playthrough, caps, expiry, or forfeiture.

12.3 Abuse. Abuse may result in forfeiture and account action.

13.1 Chat is Global. The Service includes global chat. Content may be visible to other users.

13.2 You Are Responsible. You are responsible for your Content and interactions. Do not share sensitive personal information.

13.3 Prohibited Chat/Content. You may not post or transmit Content that is:

• unlawful, defamatory, harassing, hateful, threatening, or abusive;
• sexually explicit or exploitative (especially involving minors);
• discriminatory or promoting violence or extremism;
• invasive of privacy (doxxing, personal data, stalking);
• fraudulent, deceptive, or impersonating others;
• spam, phishing, malware, or scams;
• infringing intellectual property;
• encouraging illegal activity or evasion of restrictions.

13.4 Moderation. We may (but are not obligated to) monitor, remove, block, or restrict Content, and may suspend/terminate accounts for violations. We may use automated tools and human review.

13.5 Reporting. Users may report Content through the Service or by email.

13.6 No Expectation of Privacy in Chat. Chat may be logged for security, compliance, moderation, and dispute resolution.

You may not:

• violate laws/regulations;
• cheat, collude, exploit bugs, or use bots/automation;
• manipulate outcomes or scoring;
• multi-account to evade restrictions;
• attempt to bypass geo/verification/compliance controls;
• reverse engineer, disrupt, scrape, or interfere with the Service;
• harass or harm others;
• use the Service for fraud, laundering, or illicit activity.

15.1 Right to Act. We may suspend, restrict, freeze, or terminate your Account at any time (with or without notice) if we reasonably believe you violated these Terms, created risk, or for compliance/security reasons.

15.2 Holds. We may place holds on balances or withdrawals pending review.

15.3 Forfeitures. To the extent permitted by law, we may forfeit promotional balances and reverse credits linked to abuse, fraud, or prohibited conduct.

15.4 Survival. Sections relating to IP, disclaimers, limitation of liability, arbitration, indemnification, and other provisions that should survive will survive termination.

Except where required by law or explicitly stated in the Service, all fees and Digital Asset transactions are final and non-refundable.

17.1 License. You grant Innovacore a worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting), display, distribute, and use your Content to operate, improve, and enforce the Service.

17.2 Feedback. If you provide suggestions or feedback, you grant us the right to use it without compensation or restriction.

The Service and all related software, logos, and content are owned by Innovacore or its licensors and protected by law. You receive a limited, revocable, non-transferable license for personal, lawful use only. You may not copy, sell, distribute, reverse engineer, or exploit the Service except as permitted by law.

We respect intellectual property rights and expect users to do the same.

19.1 Notice of Claimed Infringement

If you believe Content on the Service infringes your copyright, send a notice to legal@skillbetz.com with:

• Identification of the copyrighted work claimed to be infringed;
• Identification of the allegedly infringing material and where it is located on the Service (screenshots/links/IDs);
• Your name, address (optional), phone number, and email;
• A statement that you have a good-faith belief the use is not authorized;
• A statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act;
• Your physical or electronic signature.

19.2 Counter-Notification

If you believe your Content was removed in error, you may send a counter-notice to legal@skillbetz.com including:

• Identification of the removed material and where it appeared;
• A statement under penalty of perjury that removal was a mistake or misidentification;
• Your name, address, and phone number;
• A statement consenting to jurisdiction of a court of competent jurisdiction and accepting service of process;
• Your signature.

19.3 Repeat Infringers. We may terminate accounts of repeat infringers in appropriate circumstances.

The Service may integrate third-party services (KYC, analytics, blockchain infrastructure). We are not responsible for third-party services outside our control. Links to third-party sites are provided for convenience and do not imply endorsement.

We may modify, suspend, or discontinue any part of the Service at any time. Beta/experimental features are provided "as is" and may be unstable.

You are responsible for device security and account security. You assume risks of: Digital Asset volatility; network delays/failures; irreversibility of transactions; phishing/social engineering; and third-party outages.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNOVACORE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF: (A) FEES YOU PAID US IN THE 90 DAYS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

You agree to defend, indemnify, and hold harmless Innovacore and its affiliates, officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Content, your violation of these Terms, or violation of law.

PLEASE READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS.

26.1 Mandatory Arbitration (Where Permitted). Except where prohibited by law, disputes arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis.

26.2 No Class Actions. You waive participation in class actions, class arbitrations, collective actions, or representative proceedings.

26.3 Jury Trial Waiver. You waive the right to a jury trial.

26.4 Small Claims. Either party may bring an individual claim in small claims court if it qualifies.

26.5 Remote Arbitration. Arbitration may be conducted remotely by video/teleconference unless the arbitrator requires otherwise.

26.6 Severability. If any part of this section is unenforceable, the remainder remains effective to the fullest extent permitted.

To the maximum extent permitted by law, any claim must be filed within one (1) year after it arises, or it is permanently barred.

You consent to receive notices electronically (email, in-app). Your electronic acceptance constitutes a valid signature.

You may not assign these Terms without our consent. We may assign these Terms. If any provision is unenforceable, the remainder stays in effect. These Terms and the Privacy Policy constitute the entire agreement. Failure to enforce is not a waiver.
